This Privacy Policy explains how Datafication Pvt Ltd (“Datafication”, “we”, “our”, or “us”) collects, uses, discloses, and protects personal data when you visit our website, use our AI/ML products or services, or otherwise interact with us. We comply with applicable Indian laws including the Digital Personal Data Protection Act, 2023 (DPDP) and, where relevant, other data protection laws.
Customer Input Data: datasets, prompts, files, and metadata you supply to use our services.
Support Data: tickets, chat transcripts, diagnostics, and related metadata.
2. How We Use Data
Provide, operate, and improve our services and models.
Set up accounts, authenticate users, and manage billing.
Monitor performance, security, and model/service quality (including bias/drift analysis).
Respond to inquiries and provide support.
Legal compliance and to protect our rights and users.
Optional: With your consent, product updates and marketing communications (you can opt out anytime).
3. Legal Bases (where applicable)
Consent, performance of a contract, compliance with legal obligations, and legitimate interests (e.g., service improvement and security) as permitted by law.
4. Data Sharing
Vendors/Sub-Processors: cloud hosting, analytics, email, incident management—bound by contracts and confidentiality.
Legal & Safety: to comply with law or protect users, our company, or the public.
Corporate Events: merger, acquisition, or asset sale (with notice as required).
5. International Transfers
We may process data outside India using reputable cloud providers. Where required, we implement appropriate safeguards/contractual protections and ensure transfer only to jurisdictions permitted by law and/or with comparable data protection.
6. Security
We maintain administrative, technical, and organizational measures (access controls, encryption in transit/at rest where applicable, network segregation, logging/monitoring, employee training). No method is 100% secure; we continuously improve safeguards.
7. Retention
We retain personal data only as long as necessary for the purposes above, to meet legal obligations, resolve disputes, and enforce agreements.
8. Your Rights
Subject to the DPDP and other applicable laws, you may request access, correction, deletion, grievance redressal, or withdrawal of consent. Contact: founder@datafication.co.in.
9. Children
Our services are not directed to children under 18. We do not knowingly collect their personal data without appropriate consent as required by law.

We may update this Privacy Policy. We will post changes here and revise the “Last updated” date.
These Terms of Service (“Terms”) govern your access to and use of Datafication’s websites, products, and services (“Services”). By using the Services, you agree to these Terms.
1. Accounts & Eligibility
You must be at least 18 and capable of forming a binding contract. You are responsible for your account credentials and all activities under your account.
2. Services & SOWs
Details such as scope, deliverables, fees, milestones, and SLAs may be set forth in an order form or statement of work (“SOW”). In case of conflict, the SOW prevails for that engagement.
3. Customer Data & Inputs
You represent that you have all rights to provide data, prompts, and content (“Customer Data”) to the Services. You grant Datafication a limited license to use Customer Data solely to provide the Services, fulfill SOWs, and improve safety, reliability, and performance as permitted by law and the SOW.
4. IP Rights
Your IP: You own Customer Data and unique Outputs delivered for you, subject to payment and any third-party terms.
Our Background IP: We retain rights to pre-existing tools, models, frameworks, and know-how. We may reuse generic, non-confidential learnings.
5. Acceptable Use
No unlawful, harmful, or infringing content; no attempts to exploit, reverse engineer (except where legally permitted), or bypass security.
No high-risk use (e.g., life-support, autonomous weapons) unless expressly agreed in writing.
6. Confidentiality
Each party will protect the other’s confidential information with reasonable care and use it only for the engagement. Exceptions apply for information that is public, independently developed, or rightfully obtained without restriction.
7. Fees & Taxes
Fees are as agreed in the SOW or order. Amounts are exclusive of applicable taxes. Late payments may incur interest as allowed by law.
8. Warranties & Disclaimers
We provide Services with reasonable skill and care. However, Services are provided “as is.” We disclaim implied warranties to the maximum extent permitted by law, including fitness for a particular purpose. AI/ML outputs may be probabilistic, and you should evaluate fitness before production use.
9. Limitation of Liability
To the extent permitted by law: (a) neither party is liable for indirect or consequential damages; (b) each party’s aggregate liability is limited to fees paid in the 12 months preceding the claim. These limits do not apply to breach of confidentiality, IP infringement, or willful misconduct.
10. Indemnity
Each party will indemnify the other against third-party claims arising from its breach of these Terms, violation of law, or infringement caused by materials it provides.
11. Term & Termination
Either party may terminate for material breach not cured within 30 days after notice. Upon termination, you will pay for Services performed; we will return or delete Customer Data per the DPA.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Disputes will be subject to arbitration in India under the Arbitration and Conciliation Act, 1996, with venue in Uttar Pradesh, India, and proceedings in English. Courts in Uttar Pradesh shall have jurisdiction for injunctive relief.
13. Changes
We may update these Terms; material changes will be notified via the site or email. Continued use constitutes acceptance.
Data Processing Addendum (DPA)
This DPA forms part of the agreement between Customer (“Controller” under DPDP where applicable) and Datafication Pvt Ltd (“Processor”) when we process personal data on your behalf.
1. Subject Matter & Duration
Processing personal data solely to deliver the Services described in the Agreement/SOW, for the term of the engagement unless otherwise required by law.
2. Nature & Purpose of Processing
Hosting, storage, transformation, model training/inference (where permitted by SOW), monitoring, and support as necessary to provide the Services.
3. Categories of Data & Data Subjects
Business contact data; end-user/customer data provided by Controller; usage logs/telemetry. Data subjects may include Controller’s customers, employees, contractors, and end-users.
4. Controller Instructions
Processor will process personal data only on documented instructions from Controller, including transfers, unless required by law (in which case Processor will inform Controller unless legally prohibited).
5. Confidentiality & Personnel
Processor ensures personnel are bound by confidentiality obligations and receive appropriate data protection training.
6. Security Measures
Processor implements appropriate technical and organizational measures (access controls, encryption in transit/at rest where feasible, network segmentation, logging/monitoring, backup/restore, secure development practices). A detailed security schedule can be appended to the SOW.
7. Sub-Processors
Controller authorizes Processor to engage sub-processors necessary to provide the Services (e.g., cloud hosting, email, monitoring), subject to substantially similar data protection obligations. Processor will maintain a current list upon request and provide notice of material changes.
8. Assistance
Processor will assist Controller, as reasonably possible, with data subject requests, security events, and compliance with applicable data protection laws.
9. Breach Notification
Processor will notify Controller without undue delay upon becoming aware of a personal data breach affecting Controller data, providing known details and remediation steps.
10. Data Transfers
Where data is transferred outside its origin jurisdiction, Processor will implement appropriate safeguards and comply with applicable law and the Agreement/SOW.
11. Return or Deletion
Upon termination or upon request, Processor will delete or return personal data (unless retention is required by law). Deletion from backups follows standard cycles.
12. Audits
Upon reasonable prior notice and no more than annually, Controller may audit Processor’s relevant controls (via independent reports/certifications or onsite review), subject to confidentiality and safety restrictions.
Support Policy
This Support Policy describes our standard support for subscribed customers. Custom SLAs may be defined in an SOW.

3. Exclusions
Issues caused by unsupported environments, third-party changes, or Customer code/infrastructure not managed by us.
Professional services, integration work, or training beyond reasonable troubleshooting (available via SOW).
4. Uptime & Maintenance
For hosted components, we target high availability and schedule maintenance during low-traffic windows with prior notice where feasible. Binding availability SLAs apply only if defined in the SOW.
5. Data Protection in Support
Do not include unnecessary personal data in tickets. If sharing logs/snapshots, redact sensitive information wherever possible.
